Daniel Cohen is a trial and appellate lawyer with 20 years of experience in handling complex matters in state and federal courts throughout the United States. He also has extensive arbitration experience. At The Cullen Law Firm, Mr. Cohen has specialized in representing the Owner Operators Independent Drivers Association, Inc. in various class actions pending in federal courts throughout the country seeking enforcement of the federal Truth-in-Leasing regulations.
Mr. Cohen served as law clerk to Judge John Lewis Smith Jr. of the United States District Court for the District of Columbia, and as staff attorney for the Kentucky Supreme Court. He also served as Assistant Attorney General for the Commonwealth of Kentucky.

Mr. Cohen's achievements have included recovery of $30 million in insurance proceeds for a client in a nationwide class-action products liability litigation. His representations have also included advising employees of Enron in various DOJ and SEC investigations and litigation.

Mr. Cohen's publications include: "Evidentiary Privileges - Sword and Shield;" "Minimizing Conflicts Between Design Professionals and Contractors;" "Strict Products Liability - No Defense for the Manufacturer;" "Highlights of the 1993 Amendments to the Federal Rules of Civil Procedure;" and, "Resolution of Construction Disputes Regarding Differing Site Conditions. " Reported cases include:

  • Washington Speakers Bureau, Inc. v. Leading Authorities, Inc., 33 F. Supp. 2d 488 (E.D.Va. 1999)(successfully represented client in trademark/internet domain name dispute).

    MG Refining & Marketing, Inc. v. Knight Enterprises, 25 F. Supp. 2d 175 (S.D.NY 1998)(successfully represented clients in multi-million dollar commodities litigation).

    Morse/Diesel Inc, v. Trinity Industries, Inc., 67 F. 3d 435 (2d Cir. 1995)(obtained reversal of multi-million judgment against client).

    Cyril & Crowley v. Western Systems, Inc., 2001 U.S. Dist. LEXIS 453 (N.D. Cal. 2001)(successfully obtained change of venue to jurisdiction favorable for client)
  • Perfection Corp. v. Travelers Casualty & Surety, 790 N.E. 2d 817 (Ohio App. 2003)(successfully challenged defendant's claim of privilege against production of documents critical to client's case).
